1. Agreement to Terms
By accessing or using Excaliat's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.
2. Services Description
Excaliat provides cybersecurity services including but not limited to penetration testing, vulnerability assessment, security research, malware analysis, and security consulting. The specific scope of services will be defined in individual service agreements.
3. Confidentiality
All information exchanged during our engagement is considered confidential. Excaliat maintains strict confidentiality protocols and will not disclose client information without explicit written consent, except as required by law.
4. Scope and Authorization
All security testing and research activities will be conducted only within the agreed-upon scope and with proper authorization. Clients must provide written authorization for all testing activities. Unauthorized testing or exceeding the defined scope is strictly prohibited.
5. Responsible Disclosure
Any vulnerabilities discovered during our engagements will be disclosed responsibly to the client. We adhere to industry-standard disclosure practices and will work with clients to remediate identified security issues before any public disclosure.
6. Limitation of Liability
While Excaliat employs rigorous testing methodologies, we cannot guarantee the identification of all vulnerabilities. Our services are provided "as is" without warranty of any kind. Excaliat shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services.
7. Intellectual Property
All methodologies, tools, and processes developed by Excaliat remain the intellectual property of Excaliat. Reports and findings specific to client engagements will be owned by the client upon full payment.
8. Payment Terms
Payment terms will be specified in individual service agreements. Services may be suspended if payment obligations are not met according to the agreed-upon schedule.
9. Termination
Either party may terminate the service agreement with written notice as specified in the individual service contract. Upon termination, all confidential information must be returned or destroyed as per the agreement.
10. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of Pakistan. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Lahore, Pakistan.
11. Modifications
Excaliat reserves the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services after such changes constitutes acceptance of the modified terms.
